On February 5, 2019, City Council asked staff to bring back research on "recontrol," which occurs when newly built apartments are subject to rent control because the apartments replaced previously rent controlled apartments. The current Ellis Act Ordinance says:
50% of new apartments built, or the same number of apartments were removed from the market, are subject to the City's Apartment Rent Ordinance; and
An owner may seek an exemption from these recontrol requirements if 20% of the new apartments are built on-site as deed-restricted affordable rental housing consistent with the City's Inclusionary Housing Ordinance.

General Plan Amendment to change the Land Use Designation
from RN Residential Neighborhood to UR Urban Residential and
a Planned Development Zoning from the A(PD) Planned
Development to the R-M(PD) Planned Development Zoning
District for up to 691 residential units on an approximately
15.69-gross acre site.
Purpose: To describe the proposed project, the environmental
review and planning process, and obtain community input on
the project and issues to be evaluated in the Environmental
Impact Report (EIR). This Community / EIR Public Scoping
Meeting will be held in compliance with the City’s Public
Outreach Policy (6-30) and the California Environmental Quality
Act (CEQA), as amended. Public input on the scope of the EIR is
encouraged so that the review addresses all relevant
environmental issues. The Notice of Preparation (NOP) for the
EIR is available for review online in the EIR Library of the City of
San Jose’s Planning Division web site at:
